Wage and Hour Regulation
Our employment attorneys work with our clients
on the requirements of federal and state labor laws and in
defending claims brought before the Division of Labor Standards
Enforcement and the Employment Development Department. The
differences that exist between state and federal wage and
hour laws make it all the more important to seek counsel on
issues that may arise relating to overtime obligations, the
exemption requirements, vacation pay entitlement, alternative
work weeks, flex time, compensatory time off and other entitlements
to paid time off. We regularly work with our clients to develop
or update their policies, handbooks and practices, as part
of our Human Resources Counseling. When necessary,
we assist them with strategies for more difficult situations,
including handling audits by the Employment Development Department
or Internal Revenue Service relating to the determination
of the status of employees as independent contractors or employees.
