Biography

Erin-Leigh Dake is a member of the firm's litigation and real estate practice groups and has more than ten years of experience in complex litigation. Erin-Leigh's practice focuses on construction law and probate litigation.

She represents a variety of litigants in every stage of litigation. As an expert in the field of alternative dispute resolution, Erin-Leigh has successfully mediated dozens of cases that have resulted in not only favorable settlements for her clients, but also in significant savings to her clients in legal fees and costs.

In her construction practice, Erin-Leigh has represented some of the largest multi-national contractors in the world as well as subcontractors and both public and private project owners. In addition to delay, disruption, and acceleration claims, she has extensive experience in mechanic's lien claims and bid protests. Erin-Leigh has lectured at UC Berkeley Extension on mechanic's liens and insurance for contractors as part of the Construction Management certificate program.

  • Represented general contractor in bid protest on project worth in excess of $800 million
  • Achieved total defense outcome for trustee in action to remove trustee for mismanagement of trust
  • Achieved total defense outcome for commercial tenant in landlord/tenant dispute
  • Settled action to recoup workers' compensation premiums in $20 million fraud case on favorable terms for defendant
  • Represented land owner in litigation against owner of neighboring property for damage to existing structure during neighboring new construction
  • Settled action against industrial contractor for alleged soil contamination
  • Prevailed in Motion for Summary Judgment against Commercial General Liability carrier in coverage action
  • Represented public client in successful writ of mandamus before the Court of Appeal
  • Represented publically traded construction client in multi-million dollar defect claim
  • Represented joint venture partners in fraud action to recover against Director's and Officer's policy
